Title: ДНК АНАЛИЗИТЕ И НИВНАТА ПРИМЕНА ВО СИСТЕМОТ НА КАЗНЕНА ПРАВДА

Abstract: The author of this paper elaborates the question of the use of DNA analysis in criminal justice systems. At the outset, she points out that methods used in the field of genetics today are widely used in areas that do not fall within the scope of biomedicine. DNA analysis is now an integral part of the criminal justice system because it can directly and unequivocally prove the relevant facts about the criminal situation.The use of DNA analysis requires the existence of DNA databases. In the United States, the first regulations on DNA bases date back to the eighties of the 20th century, and in Europe these activities are known ten years later in the Council of Europe and the EU. The international documents and practice of the European Court of Human Rights define clear determinants of the use of DNA analysis. The author concludes that the Macedonian legislation basically fulfills the conditions determined as European standards in view of the provisions of the Law on the National Database on Criminal Intelligence, Criminal Procedure Law etc. Regardless of existing regulations, the law must keep up with the progress and new discoveries in the field of natural sciences to ensure timely and effective, adequate legal protection of human rights of citizens.
