Title: Extramarital union in Macedonian Law:Legal Bigamia or Legal Gap

Author: Angel Ristov

Abstract: The extramarital union in modern societies is becoming an increasingly accepted form of community life in which the family is founded. In modern societies, it is no longer a step towards marriage, but its alternative. Despite the tendency of increasing the number of children born out of wedlock, in a number of European legislations the extramarital union is still not legally regulated. In the legislations where the extramarital union is predicted, there are no single and unified solutions for it’s regulation. In the paper, the author analyze the extramarital union in Macedonian and comparative family law, in order to point out the need for reforms in its regulation. The current legal solution that does not predict marital barriers as a condition for the validity of the extramarital union makes Macedonian family law a rare example in comparative law that is contrary to the morality of society and the principle of monogamy
